Acceptable Use Policy

This Acceptable Use Policy (“AUP”) forms part of the TensorX Terms of Service and governs your use of the TensorX API and related Services. By using the Services, you agree to comply with this AUP.

1. General Principles

TensorX provides API access to open-source large language models for legitimate business and personal purposes. You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations, including the GDPR, the Irish Data Protection Acts, the EU AI Act, and any other applicable EU or national legislation.

2. Prohibited Uses

You may not use the Services to:

2.1 Illegal Activities

  • Violate any applicable local, national, EU, or international law or regulation
  • Facilitate fraud, money laundering, or financing of terrorism
  • Infringe upon the intellectual property rights of any third party
  • Engage in any activity that would constitute a criminal offence under Irish or EU law

2.2 Harmful Content

  • Generate content that promotes violence, terrorism, or extremism
  • Create child sexual abuse material (CSAM) or content that exploits minors
  • Produce content intended to harass, bully, threaten, or intimidate individuals
  • Generate disinformation or deepfakes intended to deceive the public or interfere with democratic processes
  • Create content that incites hatred or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic

2.3 EU AI Act Prohibited Practices

In accordance with Article 5 of the EU AI Act (Regulation (EU) 2024/1689), you may not use the Services to:

  • Deploy subliminal, manipulative, or deceptive techniques that distort behaviour and cause significant harm
  • Exploit vulnerabilities of specific groups (age, disability, social or economic situation)
  • Implement social scoring systems that evaluate or classify natural persons based on social behaviour or personal characteristics
  • Conduct real-time remote biometric identification in publicly accessible spaces for law enforcement (except where explicitly authorised by law)
  • Infer emotions of individuals in workplace or educational settings, except for medical or safety reasons
  • Create or expand facial recognition databases through untargeted scraping of images

2.4 Data Protection Violations

  • Process special category personal data (as defined in GDPR Article 9) without a valid legal basis and without prior agreement with TensorX
  • Process personal data of children (under 16 or the applicable age of digital consent in the relevant jurisdiction) without appropriate parental consent
  • Use the Services in a manner that violates the GDPR, the Irish Data Protection Acts, or any other applicable data protection legislation

2.5 Security Violations

  • Attempt to gain unauthorised access to the Services, other accounts, or systems
  • Interfere with or disrupt the Services or the infrastructure supporting them
  • Distribute malware, viruses, or other harmful code through the Services
  • Conduct vulnerability scanning or penetration testing without prior written authorisation
  • Attempt to reverse engineer, decompile, or disassemble any part of the Services

2.6 Platform Abuse

  • Resell or redistribute API access without authorisation
  • Share API keys with unauthorised third parties
  • Circumvent rate limits or usage restrictions
  • Use automated means to create multiple accounts to circumvent restrictions
  • Use the Services in a manner that degrades performance for other users

3. Your Responsibilities

  • You are responsible for all activity that occurs under your account and API keys
  • You are responsible for ensuring that your end users comply with this AUP
  • You must implement appropriate safeguards and content moderation where your application is public-facing
  • You must clearly disclose to your end users when they are interacting with AI-generated content, as required by the EU AI Act
  • You must comply with applicable model licences and usage restrictions for the models you use via the Services

4. Enforcement

TensorX reserves the right to investigate violations of this AUP and to take appropriate action, which may include:

  • Issuing warnings
  • Temporarily suspending access to the Services
  • Permanently terminating your account
  • Reporting violations to law enforcement or regulatory authorities

We will endeavour to provide reasonable notice of enforcement actions where practicable, but reserve the right to take immediate action where necessary to protect the Services, our users, or the public.

5. Reporting Violations

If you become aware of any violation of this AUP, please report it to [email protected]. We take all reports seriously and will investigate promptly.

6. Changes to This Policy

We may update this AUP from time to time. Material changes will be notified through the Services or via email. Your continued use of the Services after changes take effect constitutes acceptance of the updated AUP.
